Treaty Investor Visa (E-2)

E-2 nonimmigrant visas are possible for nationals of countries that have a treaty of commerce and navigation with the United States.  Treaty countries include Argentina, Austria, Belgium, Canada, Chile, Costa Rica, Germany, and United Kingdom, to name a few. The E-2 visa is available when investing a substantial amount of capital in a U.S. business such as a new business venture or purchasing a pre-existing business. The assets must be at risk in that they will be subject to loss if the investment fails.

Investments must be substantial and with the goal of generating a profit and not just a minimal living for the family of the investor. The substantiality of the investment is evaluated by considering the total cost of the enterprise and the assets required for the enterprise to be successful.
